Bodyfelt Mount has the following cases in the Appellate Courts of Oregon, Washington and the Ninth Circuit:

Association of Unit Owners of Riverbend v. American States Ins. Co., -- In this construction defect case, the issue before the Court of Appeals will involve anti-assignment clauses included in insurance policies. The parties filed their briefs and are awaiting oral argument.

Berreth v. A.O. Smith Corp, et al, -- This is a product liability case involving asbestos exposure. The issues on appeal involve the statute of limitations for asbestos cases and the effectiveness of service on a defendant. Briefing is on-going.

Certain Underwriters at Lloyds v. Massachusetts Bonding and Ins. Co. et al, -- One issue in this case is whether an insurer that loses at trial and is charged with the insured's defense costs is entitled to contribution from the insurers who settled before trial for the insured's defense costs. The parties are still briefing the issues in the Oregon Court of Appeals.

Port of Portland v. Starplex, -- In this indemnity case, the trial court held that the indemnity clause in the parties' contract was not enforceable and the Port of Portland was not entitled to either contractual or common law indemnity. The Court of Appeals reversed and remanded the case for entry of judgment.  Starplex petitioned the Oregon Supreme Court for review.

Rhiner v. Red Shield Insurance Co., -- Plaintiff filed this action seeking a declaration of the parties’ rights and obligations under an insurance policy. Plaintiff prevailed at the trial court level on its motion for summary judgment. On Red Shield's appeal, the issues are: whether the trial court erred in concluding that the workers’ compensation exclusion in the policy did not exclude plaintiff’s employee from coverage under the policy, whether the trial court erred in concluding that plaintiff’s employee was a ‘temporary worker’ under the language of the insurance policy, and whether the trial court erred in concluding that the language in the insurance policy was ambiguous. Briefing is complete but oral argument has not yet been scheduled.
